Terms of Service

Please read these terms carefully before using Marketing So High.

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you", or "your") and Techno Believe Solutions Ltd (Company Number: 10866509), a company registered in England and Wales with its registered address at 128 City Road, London, EC1V 2NX, GB, trading as Marketing So High ("MSH", "we", "us", or "our"). The director of the company is Chetan Sroay.

These Terms govern your access to and use of the Marketing So High platform, available at marketingsohigh.com and the application at app.marketingsohigh.com, including all associated services, features, and content (collectively, the "Service").

Acceptance of Terms

By creating an account, accessing, or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use the Service.

You represent that you are at least 18 years of age and have the legal capacity to enter into a binding agreement. If you are using the Service on behalf of an organisation, you represent and warrant that you have authority to bind that organisation to these Terms.

Description of Service

Marketing So High is an AI-powered marketing platform designed for B2B SaaS companies. The Service provides tools and features including, but not limited to:

  • AI-assisted content generation (blog posts, social media copy, email sequences)
  • Search engine optimisation (SEO) analysis and recommendations
  • Email outreach creation and personalisation
  • Social media distribution and scheduling (including LinkedIn, X/Twitter, and other platforms)
  • Marketing analytics and performance tracking
  • Brand voice learning and consistency tools

The Service is provided on a software-as-a-service (SaaS) basis. We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with reasonable notice where practicable.

Account Registration & Security

To access the Service, you must create an account by providing accurate, current, and complete information. You agree to keep your account information up to date.

You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You must notify us immediately at support@marketingsohigh.com if you become aware of any unauthorised use of your account.

We reserve the right to suspend or terminate accounts that we reasonably believe have been compromised or are being used in violation of these Terms.

Acceptable Use Policy

You agree to use the Service only for lawful purposes and in accordance with these Terms. Specifically, you must not:

  • Use the Service to send unsolicited bulk messages (spam) or engage in any form of abusive outreach
  • Generate, distribute, or publish content that is unlawful, defamatory, harassing, fraudulent, obscene, or otherwise objectionable
  • Violate the terms of service of any third-party platform connected through the Service (including but not limited to LinkedIn, Google, Meta, and X/Twitter)
  • Attempt to gain unauthorised access to the Service, other user accounts, or any related systems or networks
  • Use the Service to infringe upon the intellectual property rights of any third party
  • Reverse engineer, decompile, or disassemble any part of the Service
  • Use the Service in a manner that could damage, disable, overburden, or impair our servers or infrastructure
  • Resell, sublicence, or provide access to the Service to third parties without our prior written consent
  • Use the Service to create content that misleadingly impersonates any person or entity

We reserve the right to investigate and take appropriate action against any User who, in our sole discretion, violates this policy, including removal of content, suspension, or termination of their account.

Subscription & Billing

Early Access: The Service is currently in early access. During this period, certain features may be limited, experimental, or subject to change. Early access pricing is offered at a discounted rate and is subject to change upon general availability.

Pricing: Subscription fees are displayed on our pricing page and are subject to change. We will provide at least 30 days' notice of any price increases to existing subscribers. Price changes will take effect at the start of your next billing cycle following the notice period.

Payment: Subscription fees are billed in advance on a recurring basis (monthly or annually, depending on your chosen plan). All fees are quoted in GBP unless otherwise stated and are exclusive of applicable taxes. Payments are processed securely by Stripe.

Free Trial

We offer a 14-day free trial for new users. A valid payment method is required to start the trial. You will not be charged during the trial period. At the end of the 14-day trial, your subscription will automatically convert to a paid subscription at the then-current rate for your selected plan, and your payment method will be charged accordingly. If you do not wish to be charged, you must cancel your subscription before the trial period ends. Cancellation during the trial period is free and you will not be billed.

Auto-Renewal

All subscriptions automatically renew at the end of each billing period (monthly or annually) unless you cancel before the renewal date. You will be charged at the then-current subscription rate unless we have given you prior notice of a price change. By subscribing, you authorise us to charge your payment method on a recurring basis. It is your responsibility to cancel before the renewal date if you do not wish to continue.

Refund Policy: No refunds are issued for partial billing periods. You may cancel your subscription at any time through your account settings or by contacting us at billing@technobelieve.com. Upon cancellation, your access to the Service continues until the end of your current billing period. Free trial users are not charged if they cancel before the trial period ends. We do not provide pro-rata refunds for unused time within a billing period.

Payment Disputes & Chargebacks

If you believe a charge is incorrect, you must contact us first at billing@technobelieve.com before disputing the charge with your bank or payment provider. We will investigate and resolve legitimate billing issues promptly. If you dispute a charge with your bank or credit card company (a "chargeback") instead of contacting us first, we reserve the right to immediately suspend your account pending resolution of the dispute. If the chargeback is found to be unjustified, you will be responsible for all fees associated with the chargeback, including any administrative fees incurred by us. Repeated or fraudulent chargebacks may result in permanent termination of your account.

Failed Payments: If a payment fails, we may suspend access to your account until the outstanding balance is resolved. We will make reasonable efforts to notify you before any suspension. If payment is not received within 14 days of the due date, we reserve the right to terminate your account.

Intellectual Property

Your Content: You retain all ownership rights in the content you create, upload, or generate using the Service ("User Content"). By using the Service, you grant us a limited, non-exclusive, worldwide licence to process, store, and display your User Content solely for the purpose of providing and improving the Service.

Our Platform: The Service, including its software, design, logos, trademarks, documentation, and all underlying technology, is and remains the exclusive property of Techno Believe Solutions Ltd. Nothing in these Terms grants you any right, title, or interest in the Service beyond the limited right to use it in accordance with these Terms.

Feedback: If you provide us with feedback, suggestions, or ideas regarding the Service, you agree that we may use such feedback without restriction or obligation to you.

Third-Party Integrations

The Service may integrate with or connect to third-party platforms and services, including but not limited to LinkedIn, Google (including Google Search Console and Google Analytics), Meta, X/Twitter, and various email service providers.

You are solely responsible for your accounts on these third-party platforms and for ensuring your use of the Service complies with their respective terms of service. We do not control and are not responsible for the actions, policies, or availability of any third-party service.

You authorise us to access and interact with your connected third-party accounts solely to the extent necessary to provide the Service. You may disconnect any third-party integration at any time through your account settings.

We are not liable for any consequences arising from changes to third-party platform APIs, terms of service, or policies that may affect the functionality of our integrations.

AI-Generated Content

The Service utilises artificial intelligence to generate marketing content. While we strive for accuracy and quality, AI-generated content may contain errors, inaccuracies, or unintended outputs.

You are responsible for reviewing, editing, and approving all content before publication or distribution. We recommend that you do not publish AI-generated content without human review.

We do not guarantee that AI-generated content will be free from intellectual property claims by third parties. You are responsible for ensuring that any content you publish complies with applicable laws and does not infringe on the rights of others.

Data & Privacy

Your privacy is important to us. Our collection and use of personal data is governed by our Privacy Policy, which forms part of these Terms.

We process data in accordance with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018. We implement appropriate technical and organisational measures to protect your data.

We do not sell your personal data to third parties. We may use anonymised, aggregated data to improve the Service and for analytical purposes.

Service Availability

We strive to provide a reliable and high-quality service, but we do not guarantee any specific level of uptime or availability. The Service is provided on a "best effort" basis.

The Service may be temporarily unavailable due to:

  • Scheduled maintenance (we will endeavour to provide advance notice)
  • Emergency maintenance or security patches
  • Third-party service outages (including but not limited to cloud hosting providers, payment processors, and social media platform APIs)
  • Factors beyond our reasonable control (see Force Majeure)

We shall not be liable for any loss, damage, or inconvenience caused by any period of unavailability. We do not offer service level agreements (SLAs) or uptime guarantees unless separately agreed in writing.

Limitation of Liability

To the maximum extent permitted by applicable law:

  • The Service is provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
  • We do not warrant that the Service will be uninterrupted, error-free, or secure, or that any defects will be corrected.
  • In no event shall Techno Believe Solutions Ltd, its directors, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, business opportunities, or goodwill, arising out of or in connection with your use of the Service.
  • Our total aggregate liability for any claims arising out of or relating to these Terms or the Service shall not exceed the greater of (a) the total fees paid by you in the 12 months preceding the claim, or (b) one hundred pounds sterling (GBP 100).

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by English law.

Indemnification

You agree to indemnify and hold harmless Techno Believe Solutions Ltd and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with:

  • Your use of the Service or any content you generate, publish, or distribute through the Service
  • Your violation of these Terms or any applicable law or regulation
  • Your infringement of any third-party rights, including intellectual property rights
  • Your violation of any third-party platform terms of service in connection with your use of the Service

Termination

By You: You may terminate your account at any time by cancelling your subscription and contacting us to request account deletion. We will process deletion requests within 30 days.

By Us: We may suspend or terminate your access to the Service immediately, without prior notice, if we reasonably believe that you have violated these Terms, engaged in fraudulent activity, or if required to do so by law.

Effect of Termination: Upon termination, your right to use the Service ceases immediately. We may delete your account data within 90 days of termination, unless retention is required by law. We will make reasonable efforts to allow you to export your User Content prior to deletion.

Sections relating to Intellectual Property, Limitation of Liability, Indemnification, and Governing Law shall survive termination of these Terms.

Dispute Resolution

If you have a dispute or complaint regarding the Service, we encourage you to resolve it by contacting us directly first:

We will acknowledge your complaint within 2 business days and aim to resolve it within 14 business days. If we cannot resolve the dispute to your satisfaction through our internal complaints process, either party may refer the matter to mediation before resorting to court proceedings.

Nothing in this section prevents either party from seeking urgent interim relief from a court of competent jurisdiction where necessary to protect their rights.

Changes to Terms

We reserve the right to update or modify these Terms at any time. When we make material changes, we will:

  • Update the "Last updated" date at the top of this page
  • Notify you via email or through a prominent notice on the Service at least 14 days before changes take effect

Your continued use of the Service after any changes take effect constitutes your acceptance of the revised Terms. If you do not agree with the updated Terms, you must stop using the Service and cancel your account.

Force Majeure

We shall not be liable for any failure or delay in performing our obligations under these Terms where such failure or delay results from circumstances beyond our reasonable control, including but not limited to:

  • Natural disasters, epidemics, or pandemics
  • Acts of war, terrorism, or civil unrest
  • Government actions, sanctions, or embargoes
  • Failure of third-party services, including cloud hosting, payment processors, or API providers
  • Power outages, internet service disruptions, or telecommunications failures
  • Cyberattacks, including distributed denial-of-service (DDoS) attacks
  • Labour disputes or strikes

In the event of a force majeure event, our obligations under these Terms shall be suspended for the duration of the event. We will use reasonable efforts to mitigate the impact and resume performance as soon as practicable.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising from or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of England and Wales.

General Provisions

Entire Agreement: These Terms, together with our Privacy Policy and any other policies or documents referenced herein, constitute the entire agreement between you and Techno Believe Solutions Ltd regarding the Service and supersede all prior agreements, understandings, representations, and warranties, both written and oral, regarding the Service.

Severability: If any provision of these Terms is found to be unenforceable, invalid, or illegal by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining provisions of these Terms remain in full force and effect.

Waiver: Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver of any provision of these Terms will be effective only if in writing and signed by us. No single or partial exercise of any right or remedy shall preclude any further exercise of that or any other right or remedy.

Assignment: You may not assign or transfer these Terms, or any rights or obligations hereunder, without our prior written consent. We may assign these Terms without restriction. Any attempted assignment in violation of this section shall be void.

No Third-Party Beneficiaries: These Terms do not confer any rights or remedies on any person or entity other than you and Techno Believe Solutions Ltd.
